United Airlines may have to defend a different interpretation. A federal judge on Monday refused to dismiss a proposed class action accusing the Chicago-based carrier of charging passengers extra for “window seats” that were, in some cases, next to solid aircraft walls, according to Reuters. The judge rejected United’s argument that “window” merely described a seat’s position next to the cabin wall and away from the aisle, Reuters reported. Passengers sued United after finding themselves seated beside walls on several types of aircraft. The missing windows can result from the placement of aircraft components, including air-conditioning ducts. The plaintiffs say United failed to clearly disclose that some window seats came without the scenery, despite passengers paying extra for them. According to Reuters, travelers may prefer windows to ease fear of flying or motion sickness, entertain children, or get more light. The judge said United’s ticketing terms, boarding passes and reservation screens expressly indicated that passengers who paid for window seats would receive them, allowing the breach claims to proceed. United told Reuters it has since added more detail to its seat-selection process so passengers have additional information about what to expect. Delta Air Lines faces a similar proposed class action in federal court in Brooklyn, New York, and is seeking dismissal, Reuters reported. Both lawsuits seek millions of dollars on behalf of more than 1 million passengers per carrier.
