Walter Greek, a driver for Dansville Central School District, was driving an empty bus into the district’s bus garage parking lot on April 5, 2022, when he lost control and struck a parked bus. He was found in cardiac arrest and remained comatose until his death five days later, according to Matter of Greek v. Dansville Central School District , decided by the Appellate Division, Third Department. Mr. Greek had been treated for an irregular heartbeat and cardiomyopathy but had been cleared to safely operate a commercial vehicle. Following the crash, doctors diagnosed brain injuries from prolonged loss of circulation, along with kidney, lung and rib injuries. The self-insured district argued that a cardiac event unrelated to work caused Mr. Greek to lose consciousness and that resuscitation efforts caused his rib and lung injuries. His treating cardiologists testified, however, that chest trauma could have triggered the abnormal heart rhythm. One said it was impossible to determine with certainty whether the arrhythmia preceded the crash or resulted from it. The district’s medical reviewer acknowledged assuming that a cardiac event occurred first. The appeals court upheld the Workers’ Compensation Board’s finding that the injuries arose from the work-related accident or necessary treatment. It also upheld death benefits, citing a medical examiner’s testimony that crash injuries placed additional stress on Mr. Greek’s heart and contributed to his death. The court said that a work-related injury need only contribute to a worker’s death to support death benefits. The district also sought to end Mr. Greek’s injury claim because he died before it could be resolved. The court found that surveillance footage, medical records and an independent medical review allowed the district to contest the claim despite his death.
