S.B. 1032, introduced Tuesday, would require staffing agencies to provide proof of a current workers compensation policy when registering or renewing registration with the Labor Commissioner. The commissioner would be required to notify the director of the Department of Industrial Relations about agencies that don’t have a policy in place. The DIR would be required to serve a stop-work order on the agency. The bill would require the Labor Commissioner to post a list of registered staffing agencies on the DIR website and prohibit businesses from using a staffing agency without first verifying it is registered. S.B. 1032 would also allow registered staffing agencies to sue unregistered agencies or businesses using a staffing agency without first verifying registration. Courts would be allowed to enjoin a defendant from operating an unregistered agency or from using the services of an agency without first verifying registration. A firm that prevails in an action would be entitled to actual damages or statutory damages of $75,000 and reasonable attorney fees and costs.
