A.B. 2098 would require, when possible, for injured workers to make a “reasonable effort” to schedule medical appointments outside regular work hours. The measure specifies that such efforts should not require workers to delay medically necessary treatment. If treatment must occur during work hours, workers would need to provide advance notice when the timing is foreseeable, or notify the employer as soon as practicable if it is not. Employers would be required to allow the leave unless a “business necessity” requires the treatment to occur at another time or on a different day. The bill also provides that leave taken for treatment would run concurrently with leave under the federal Family and Medical Leave Act and the California Family Rights Act when the worker is eligible for those programs. In addition, the measure would make it a violation of existing law prohibiting discrimination against workers compensation claimants if an employer improperly denies a worker’s request to attend scheduled treatment during work hours.
