In Bivens v. Acadia Healthcare Management Inc. , Judge Audrey Headrick ruled that Sarah Bivens was unlikely to prove that her injuries arose out of her employment. Ms. Bivens testified that she tripped while walking down a hallway carrying a water bottle and attributed the fall to a “tremendously uneven” floor. She struck her head and fractured her knee, requiring surgery and a hospital stay of about two and a half weeks. Acadia denied the claim as idiopathic, arguing that no workplace hazard contributed to the fall. Surveillance video showed Ms. Bivens appearing to trip and fall forward, but the court said the hallway floor appeared level and no hazard was visible. Although Ms. Bivens identified an uneven floor as the alleged cause, the court said she offered no detailed description or other evidence establishing the unevenness. Her testimony that the day was stressful and that she had spent considerable time on her feet also did not establish that the injury arose from a work-related hazard. The court denied her request for benefits at the expedited stage, ruling that she had not shown she was likely to prevail at a full hearing. The case remains pending, with a status hearing scheduled for Aug. 24.
