S.B. 92 would impose new employer obligations regarding performance quotas, employee access to productivity data, and anti-retaliation safeguards. Under the proposal, which would take effect Oct. 1, 2026, employers operating large warehouse facilities — defined as those with at least 250 employees at a single location or 1,000 across multiple sites — would be required to provide written descriptions of any work performance quotas to employees and notify workers when those quotas change. Employers also must maintain detailed “work speed data,” including individual and aggregated productivity metrics, and retain such records for at least three years. The bill would prohibit quotas that interfere with legally mandated meal and bathroom breaks or otherwise penalize employees for taking such breaks. Paid and unpaid breaks could not be counted toward productive time for the purposes of meeting quotas unless workers are on call. In addition, the measure would create both current and former employee rights to request quota descriptions and associated work speed data. Employers would have five calendar days to provide requested records in writing, including in the employee’s primary language. Anti-retaliation language would prohibit employers from disciplining, terminating or discriminating against workers for seeking quota information or filing civil actions under the bill. A rebuttable presumption of retaliation would apply to adverse actions taken within 90 days of those activities. Enforcement provisions would allow employees or the attorney general to bring civil actions for violations, with civil penalties ranging from $1,000 for a first violation up to $3,000 for repeat offenses. The bill also directs the state Workers’ Compensation Commission to monitor warehouse injury rates and report elevated figures to labor officials. S.B. 92 was sent to the Joint Committee on Labor and Public Employees for consideration.
