In an order issued Monday, Judge Debra Squires-Lee of Suffolk County Superior Court barred Howden from interfering with former Brown & Brown employees’ contractual nonsolicitation obligations, whether or not they are parties to the lawsuit. The order also bars Howden from encouraging or facilitating their solicitation of Brown & Brown customers or employees and from using Brown & Brown confidential information to solicit customers or employees. “Howden’s recalcitrance, obtuse and overly narrow reading of the Initial Order, and failure to conduct obvious searches for responsive documents, have significantly delayed this case to Plaintiffs’ detriment,” Judge Squires-Lee said in the order. Howden was also ordered to pay Brown & Brown’s attorney fees related to the discovery dispute and subsequent hearings. Howden declined to comment on the order. The ruling follows Judge Squires-Lee’s decision to extend the discovery period, giving Howden US until Oct. 16 to produce additional documents in the case.
