Giant Eagle filed the lawsuit, Giant Eagle, Inc. v. Aon Risk Services Central, Inc., on June 17 in the U.S. District Court for the Western District of Pennsylvania. It accuses Aon Risk Services Central and Aon Financial Services Group of failing to properly notify Giant Eagle’s D&O insurers of opioid-related lawsuits, despite being paid extra fees for the task. Giant Eagle, based in Cranberry Township, Pennsylvania, says it hired Aon as its broker from 2014 to 2025 and paid additional fees starting in 2018 for claims advocacy services, under which Aon was supposed to identify and notify all insurers that might cover a claim. When Ohio governmental entities sued Giant Eagle beginning in 2018 over its role in the opioid epidemic, the company says it asked Aon to notify its full insurance tower, including Westchester, Navigators Insurance and Argonaut Insurance. According to the complaint, Aon sent notice to Chubb’s general claims email rather than the address listed in the D&O policy and never notified Navigators or Argonaut at all. The insurers later denied coverage for late notice, a dispute now in arbitration. Giant Eagle says it has already spent more than $1 million litigating that notice defense and stands to forfeit the full $40 million in D&O limits if the insurers prevail. “Aon’s claims advocacy services did not come cheaply,” the complaint states. “Giant Eagle had to pay Aon substantial additional fees to no longer worry that timely notice would be given to the right insurer(s) for each new claim.” The complaint also says Aon’s parent company, Aon PLC, acknowledged in a 2018 SEC filing that errors-and-omissions claims against it “could include… the failure of our employees or sub-agents… to place coverage correctly or notify carriers of claims on behalf of clients.” Grocery and pharmacy chains nationwide have paid billions in settlements in the wake of the opioid crisis. Giant Eagle has been named in more than 30 lawsuits for allegedly failing to establish proper controls over the distribution of opioids, according to the complaint. Giant Eagle is seeking actual and punitive damages and has demanded a jury trial. Aon did not immediately respond to a request for comment.
