In Mohammed Bouayad v. Normandy Insurance Co. , the court overturned an appellate ruling that found injuries Mr. Bouayad sustained when he was repeatedly shot by an unidentified assailant were not compensable. Mr. Bouayad, the general manager of a car rental business near Orlando International Airport, was shot around midnight while walking from a hotel kiosk to an outside office at the end of his shift. A workers compensation judge awarded benefits after finding that Mr. Bouayad’s duties and work environment, including working late, carrying rental agreements and potentially cash, firing employees and walking through an unsecured and poorly lit area, increased his risk of attack. The 1st District Court of Appeal reversed, finding that Mr. Bouayad’s act of walking between the two work locations did not cause the shooting. The Supreme Court said that analysis improperly applied tort-law causation principles to Florida’s no-fault workers compensation system. A claimant may establish that an assault was work-related by showing either that the assailant had a work-related motive or that the employee’s overall duties and work environment exposed the employee to an increased risk, the court said. The Supreme Court sent the case back to the appeals court to review the evidence under the correct legal standard. It did not make a final determination that Mr. Bouayad is entitled to benefits.
