The House on Wednesday voted 82-13 to pass H.B. 357, which would require the Office of Workers’ Compensation Administration to implement a new medical fee schedule by Jan. 1, 2027. The new fee schedule would have to be reasonable in comparison to the current fee schedule — based on the mean of the usual and customary charges for services — and have similar characteristics as fee schedules in surrounding states. The proposal would also direct the administration to examine potential administrative and procedural relief for providers to ensure expedited care and payment, ways to reduce paperwork for providers, and processes to expand medical markets for more access to patient care. The House on Wednesday also voted 96-0 to pass H.B. 537, which would eliminate the Workers’ Compensation Advisory Council. The council was created by statute in 2011 and consists of 17 members appointed by the governor and confirmed by the Senate. A similar proposal to eliminate the advisory council failed to advance out of committee in 2024. Opponents of the advisory council have been arguing since at least 2018 that it is partisan and stacked against employers. Both bills were sent to the state Senate for additional hearings.
