In Ex parte Waterville USA, Inc. (In re Isabell Norton Altamira v. Waterville USA, Inc.) , the Alabama Court of Civil Appeals granted Waterville USA’s petition for a writ of mandamus. The worker alleged that a June 2021 workplace accident injured her head, left shoulder and back. Although Waterville had voluntarily provided disability and medical benefits, it denied liability under the Alabama Workers’ Compensation Act and disputed that the accident caused a permanent injury. The worker sought an order requiring Waterville to schedule a consultation recommended by an authorized treating physician. The Baldwin County Circuit Court granted the motion without taking testimony or receiving evidence beyond the pleadings. The appeals court said an employer disputing compensability cannot be compelled to provide additional treatment based solely on a worker’s allegations. Compensability and the reasonableness and necessity of the proposed care must first be established through an evidentiary hearing or an appropriate judgment procedure, the court held. Waterville’s earlier voluntary payment of benefits did not constitute an admission of liability or prevent it from contesting the claim, the court said.
