In Record No. 0269-25-2 , the Court of Appeals of Virginia on July 14 affirmed a Virginia Workers’ Compensation Commission decision awarding reimbursement for medical treatment, prescriptions and related travel. The researcher was working at the Pentagon for RAND when it was attacked. The commission awarded her temporary disability benefits in 2003 and medical benefits for as long as necessary. RAND stopped reimbursing her in 2010, contending she had not provided records establishing that later treatment was reasonable, necessary and related to her compensable PTSD. The parties settled claims through August 2014, but continued litigating expenses incurred after that date. The appeals court said credible evidence supported the commission’s conclusion that her continuing treatment was related to the attack. Her health care providers diagnosed PTSD and connected her symptoms to Sept. 11, and the researcher testified about continuing depression, sleeplessness, isolation and difficulty finding work. The court said causation does not have to be established exclusively through medical evidence and may be proved through a claimant’s testimony. The court also rejected RAND’s argument that requiring her to submit receipts for reimbursement improperly reopened the evidentiary record. The receipts were documentation of expenses after compensability had been decided, rather than new evidence offered to prove the claim, the court said.
