The decision, in Igloo Products Corp. v. Allianz Global Risks US Insurance Company , was issued Wednesday by the U.S. District Court for the Northern District of Illinois. Igloo recalled about 1 million 90-quart coolers in February 2025 after a dozen injury complaints, including fingertip amputations, bone fractures and lacerations, according to the U.S. Consumer Product Safety Commission. Igloo, based in Katy, Texas, is a unit of Sweden’s Dometic Group. Allianz issued Dometic four commercial general liability policies from 2021 to 2025, under which it agreed to defend lawsuits seeking damages because of bodily injury, court records show. In 2025, buyers of Igloo’s Flip & Tow 90 QT coolers filed five individual class actions and one consolidated class action over the handle. The judge found that four of the six plausibly allege bodily injury, while two others did not. The judge rejected Allianz’s argument that the causes of action in the suits foreclosed coverage. A duty to defend, she wrote, “depends on the facts alleged in the actions — not the legal theories raised by those facts.” She also found the alleged injuries plausibly resulted from an “occurrence,” meaning an accident, because the complaints say Igloo was negligent or “knew or should have known” of the defect. She dismissed the claims tied to two of the actions but denied Allianz’s motion as to the three other individual class actions and the consolidated class action.
