In Hernandez, Yonny Perez v. PR Marine Construction LLC , a judge in the Tennessee Court of Workers’ Compensation Claims held that the employee is likely to prevail in proving entitlement to benefits stemming from a severe workplace injury. Yonny Perez Hernandez was injured in July 2023 while helping carry a large post that fell on him, leaving him with significant back and jaw injuries that required surgery and hospitalization, according to the April 8 expedited hearing order. After initial treatment and several follow-up visits, Mr. Hernandez testified he was unable to obtain additional care from his employer. He later moved to Texas and was deported to Mexico in September 2024. PR Marine Construction argued that the worker failed to provide medical proof linking his current symptoms to the workplace accident and contended that benefits should not be owed because he is no longer in the United States and lacked legal work status. The court rejected both arguments. The judge found that the severity of the accident — including emergency airlift, a wired jaw and back surgery with implanted hardware — made the causal connection between the injury and current symptoms “obvious,” eliminating the need for expert medical proof at this stage. The court also said Tennessee law does not exclude workers from receiving benefits based on immigration status or residency. The statute defines an employee as a person “whether lawfully or unlawfully employed,” and requires employers to provide medical treatment when needed, the order said. Additionally, logistical challenges associated with providing care in Mexico do not relieve the employer of its obligation to furnish treatment, the court said. The judge granted the employee’s request for medical benefits and ordered the employer to provide treatment reasonably necessary for the injury.
