H.B. 1101, introduced Tuesday, would for the first time define “maximum medical improvement, or MMI, in statute as the point at which an employee’s condition is unlikely to substantially improve, even if ongoing treatment is needed to manage symptoms or chronic pain. The proposal would tie the duration of temporary total disability benefits to that definition, providing that such benefits end when an injured worker reaches MMI, with a maximum duration of 156 weeks. The bill would also reduce the maximum duration of supplemental earnings benefits to 416 weeks from 520 weeks under current law. In addition, the measure would impose new limits on income benefits, terminating them when an employee reaches age 75 or five years after injury or last exposure, whichever is later. It also sets separate limits on death benefits tied to the employee’s age or time since injury. The legislation further addresses fraud, specifying that the elements required to establish misrepresentation of benefits are exclusive and clarifying that certain false statements cannot be excused even if they do not affect a medical opinion. The proposal also revises vocational rehabilitation provisions, emphasizing a return to “suitable gainful employment” and allowing employers to select rehabilitation counselors, while creating an expedited process for resolving disputes .
