S. 9998 proposes revising the New York Workers’ Compensation Law to clarify that unpaid student interns “shall not be deemed to be employed or engaged in employment” under the statute, effectively removing them from mandatory workers compensation protections. The legislation defines a student intern as an individual enrolled in an educational program at a public or private secondary school, charter school or board of cooperative educational services who participates in an unpaid internship, externship or similar program primarily for educational or training purposes. Current law broadly requires employers to provide workers compensation coverage for most employees, with certain enumerated exceptions. The bill would add unpaid student interns to those exclusions. If enacted, the change could affect schools, nonprofit organizations and businesses that host student interns as part of training or educational programs, potentially limiting liability for workplace injuries involving those individuals. The bill has been referred to the Senate Labor Committee and would take effect immediately upon enactment.
