The department’s Occupational Safety and Health Administration, in a statement issued Thursday, said it investigated a whistleblower complaint filed by the terminated employees of Rise Construction LLC and Niko Group LLC. According to OSHA, the workers alleged they were dismissed after alerting company owners to concerns about a lack of training and asbestos certification, inadequate personal protective equipment and the illegal dumping of asbestos-containing materials. OSHA determined the firings violated federal whistleblower protections under the Clean Air Act, the Solid Waste Disposal Act and the Toxic Substances Control Act. The agency ordered the companies and their owners to reinstate the two workers and pay more than $200,000 in back wages and interest, including compensatory and punitive damages.
