Gov. Ned Lamont signed H.B. 5003, now Public Act 26-12, on May 11. Its workers compensation provisions took effect Oct. 1. The enhanced benefits apply to compensable injuries that result in total or partial incapacity to work following a physical or negligent assault while performing job duties. The law also covers reasonable expenses for medical and other necessary services resulting from the assault, as well as wages lost for related court appearances. Covered employees retain full salary during qualifying absences, although workers compensation awards may be deducted from salary payments. Absences cannot be charged against sick leave, vacation or personal days. The provisions cover teachers and other employees of specified public education boards, along with health care providers and other employees at qualifying facilities. State-operated health care facilities are excluded from these provisions, except for the University of Connecticut Health Center. The law does not explain why. However, a separate law, Public Act 26-68, Section 222, which also took effect Oct. 1, extends hazardous-duty disability benefits to qualifying state-employed health care providers injured in on-duty assaults.
