H.B. 1119 would amend state law to let employers direct injured workers’ prescription drug care through contracted pharmacy management networks or, alternatively, permit workers to obtain medication from pharmacies or dispensing providers of their choosing. The measure sets detailed requirements for prescribing, dispensing and reimbursement. Under the proposal, prescribing providers would be required to document medical necessity for medications and obtain prior authorization for compounded drugs and off-label prescriptions. Most prescriptions would be limited to 30-day supplies, while compounded medications could be approved for up to 90 days but dispensed only in 30-day increments. During the first seven days after an injury, patients would be restricted to a five-day supply of Schedule II and III controlled substances and a 14-day supply of all other medications. The bill also would establish licensing and operational standards for pharmacy management networks, including registration with the state, payment of a fee and compliance with requirements governing provider access, reimbursement, dispute resolution and mail-order services. Networks meeting the standards would be exempt from certain regulations that apply to pharmacy benefit managers and third-party administrators. Employers using a pharmacy management network would be required to notify injured workers of network rules and participating dispensing providers. Medication reimbursement would be tied to Georgia’s workers compensation fee schedule, and state officials would be authorized to adopt rules necessary to implement the changes. If approved, the legislation would take effect Jan. 1, 2027, and would repeal conflicting provisions of state law.
