In Sam McDonald v. State of Wyoming, ex rel. Department of Workforce Services, Workers’ Compensation Division , the high court affirmed a district court ruling upholding the Wyoming Medical Commission’s denial of medical and temporary total disability benefits. Mr. McDonald injured his head in late 2014 when a car hood fell on him while he was working as a mechanic. The injury was accepted as compensable, and he received workers comp benefits. He later developed debilitating migraines and was treated with Depakote, a medication he had already been taking before the accident for depression and bipolar disorder. The dosage was later increased to help treat his migraines, and Mr. McDonald developed pancreatitis. He argued that the condition was a second compensable injury related to the work accident. The court said substantial evidence supported the commission’s finding that Mr. McDonald failed to prove the increased Depakote dosage caused his pancreatitis. Expert testimony showed pancreatitis from Depakote is rare and can occur at any time and at any dose, with or without dosage changes. Because he failed to prove causation, the court held that he was not entitled to medical or additional temporary total disability benefits for pancreatitis.
