In Peed v. Essential Staffing Inc. , the state’s high court Monday affirmed lower decisions that Craig Peed failed to show that problems with his lower teeth were caused by his 2012 workplace accident. Mr. Peed suffered serious injuries and received total disability benefits after the accident. Several years later, his upper teeth began fracturing at the gum line, and the Delaware Industrial Accident Board found the damage was related to the accident. Essential Staffing’s workers comp insurer paid for treatment. In 2023, Mr. Peed developed problems with his lower teeth, which had worn down significantly. His dentist testified that crowns on his upper teeth had worn down the lower teeth and that the deterioration was also consistent with a lack of dental care while Mr. Peed was in a coma after the accident. An employer expert disputed those conclusions. The IAB denied additional benefits, crediting the employer’s expert, and the Superior Court affirmed that decision. The Supreme Court rejected Mr. Peed’s argument that the IAB’s earlier causation findings precluded it from reaching a different conclusion. The earlier proceeding concerned his upper teeth, while the latest claim involved his lower teeth and presented a different causation issue, the court said. The court also ruled that substantial evidence supported the IAB’s decision.
