In Dodge v. Commissioner of Motor Vehicles , the court affirmed a decision allowing state and municipal employers to recover from asbestos-related product liability settlements obtained by the estate of a deceased worker who developed mesothelioma. The decedent had been exposed to asbestos both on the job and outside of work over several decades. After his death, his estate and surviving spouse secured more than $500,000 in settlements from manufacturers and suppliers of asbestos-containing products. They also obtained workers compensation benefits after a finding that occupational exposure was a substantial contributing factor to the disease. At issue was whether the employers’ lien rights extended to settlement proceeds attributable to nonoccupational exposure. The plaintiff argued that those amounts should be excluded because they did not arise from a work-related “injury.” The court rejected that argument, concluding that the worker suffered a single compensable occupational disease — mesothelioma — even though it had multiple causes. Because the disease was substantially linked to employment, it qualified as a work-related injury under the state’s Workers’ Compensation Act, the court said. As a result, the employers’ lien rights mirrored their obligation to pay benefits and extended to all settlement proceeds tied to that injury, regardless of whether exposure occurred on or off the job.
