H.B. 2049 would amend the state Workers’ Compensation Act to increase the maximum burial expense payable by employers or insurers in death claims to $20,000 from $7,000. The bill would require any money paid to an undertaker in excess of actual burial expenses to be refunded, without deduction, directly to the surviving spouse or other dependents of the deceased in the order provided under state law. The measure would require employers or insurers to provide written notice to undertakers of their responsibility to refund excess money. Undertakers refunding excess payments would have to provide an itemized accounting of burial-related expenses and obtain a notarized acknowledgment that the person receiving the refund is entitled to the money. In the event of a payment dispute, a petition could be filed with the Department of Labor and Industry for review by a workers compensation judge after 60 days from the provision of all burial-related services. A judge could issue an order resolving disputes related to payment or services and impose penalties for violations. The bill was introduced Nov. 18, 2025, and amended on second consideration in the House on Tuesday. It would take effect 60 days after enactment.
