Aeropres Corp. employees George Hardaway, Chancey Hawk and Daniel Payne suffered severe burns while transferring liquid propane into a tanker truck at a Cotton Valley, Louisiana, facility on May 9, 2022. Mr. Hawk died from his injuries on June 30, 2022. The workers and family members sought damages, including wrongful death and survival damages, in consolidated litigation led by George Reagan Hardaway et al. v. Aeropres Corp. , before the Louisiana Court of Appeal, Second Circuit. The facility was owned by XTO Energy Inc. and leased and operated by Aeropres. According to the ruling, a hose connection failed during the transfer, releasing more than 200 pounds of liquid propane that vaporized and ignited. The plaintiffs initially sued Aeropres, alleging intentional tort among other claims, and later added XTO. They alleged that a defective loading rack allowed leaking gas to accumulate rather than dissipate. XTO sought partial summary judgment on the intentional-tort claims, arguing, among other things, that it was not the workers’ employer. The trial court denied its motion. At oral argument, the plaintiffs acknowledged that they did not wish to pursue intentional-tort claims against XTO and had opposed its motion to preserve their claims against Aeropres. The appeals court reversed and dismissed the intentional-tort claims against XTO with prejudice. The ruling did not resolve the claims against Aeropres or other theories of liability against XTO.
