In State ex rel. Columbus City Schools, Columbus Bd. of Edn. v. Brookbank-Mizer , the court, in reversing, said the commission did not fully analyze whether the worker’s inability to work during the summer was directly caused by her injury, as required under law. The claimant, a speech therapist employed on a nine-month schedule, was injured in 2021 and received temporary total disability benefits. The dispute centered on whether she remained eligible for those benefits during the 2022 summer recess, when she was not scheduled to work. The commission had awarded benefits, relying on prior case law, but the high court said both prongs of the statute must be considered — including whether the employee was “not working” for reasons unrelated to the injury.
