Cincinnati won summary judgment against American Financial Group subsidiary Bridgefield Casualty Insurance, which had sought reimbursement for a settlement it paid to resolve the underlying injury claim. The case, Bridgefield Casualty Insurance Co. v. The Cincinnati Insurance Co. , was decided by Judge Charlene Edwards Honeywell of the U.S. District Court for the Middle District of Florida in Tampa. In a 2019 accident in Charlotte County, Florida, Jasmine Juarez, an employee of a subcontractor, was struck by a track loader operated by an employee of the general contractor, C-Squared Certified General Contractor. C-Squared held policies with both insurers. Cincinnati Insurance took on C-Squared’s defense while reserving its rights to challenge coverage later, while Bridgefield Casualty denied coverage outright. Cincinnati Insurance’s lawyers helped negotiate a settlement in which C-Squared agreed to a $5.25 million arbitration award. But Ms. Juarez agreed not to collect it, in exchange for C-Squared assigning her its rights against Bridgefield Casualty. Ms. Juarez then sued Bridgefield Casualty for breach of contract, and Bridgefield Casualty eventually settled that claim confidentially. Bridgefield Casualty then sued Cincinnati Insurance, arguing it deserved reimbursement because it believed Cincinnati Insurance’s policies should have covered the loss. Judge Honeywell disagreed, finding that Bridgefield Casualty’s payment settled its liability for “failure to defend or indemnify its insured C-Squared.” The judge also found that none of Cincinnati Insurance’s policies would have covered the accident anyway: its umbrella policy had been canceled months earlier, the track loader wasn’t a covered vehicle under its auto policy, and Ms. Juarez counted as a “statutory employee” of C-Squared, triggering an exclusion in the general liability policy related to workers compensation immunity. Cincinnati Insurance is based in Fairfield, Ohio, and Bridgefield Casualty is based in Lakeland, Florida.
