Neil Adams was fatally shot in February 2022 while working private security at Houston’s Sharpstown Mall in his constable uniform. His widow Dianna Adams sought workers compensation death benefits, arguing he remained in the course and scope of his county employment because he was acting as a peace officer when responding to a disturbance. The Texas Department of Insurance’s Division of Workers’ Compensation denied the claim, finding he was not acting within the scope of county employment at the time of the shooting. Ms. Adams then sued for judicial review and sought declaratory relief, asking the court to declare that peace officers working approved extra-duty jobs remain within the scope of employment when crimes occur in their presence. A trial court denied the risk pool’s plea to the jurisdiction and granted summary judgment in her favor. The Ninth Court of Appeals in Beaumont reversed, finding the risk pool qualifies as a governmental unit because it administers counties’ self-insured workers compensation pools under Texas interlocal agreements. As such, it is entitled to governmental immunity unless the Legislature clearly waives that protection. The court held that while Texas law waives immunity for claims against an “insurance carrier,” that designation applied to San Jacinto County — the self-insured employer — not the risk pool, which the judges said merely administers the claim and does not itself qualify as the insurer under the state law.
