In Mayor v. Workers’ Compensation Appeals Board , the court unanimously upheld an appeals court ruling in favor of injured worker Joseph Mayor. Mr. Mayor was injured while working for Ross Valley Sanitation District in December 2013. A workers comp judge later found him totally and permanently disabled, but the district asked the board to reconsider the award. Under the law in effect at the time, the board had 60 days to act on the employer’s request, but it did not agree to reconsider the award until 144 days after the request was filed. The board said it had not received notice of the filing until after the deadline had passed. Mr. Mayor challenged the board’s decision to grant reconsideration in state appeals court, arguing that it should be set aside because the board had missed the 60-day deadline. The appeals court agreed, and the California Supreme Court affirmed, ruling that the 60-day deadline was mandatory and the board could not extend it because of administrative delays. “The statute’s plain language indicates that its purpose is to limit the time for the Appeals Board to act,” the court said. California has since changed the law so that the 60-day period begins when a workers comp judge sends the case to the board rather than when the request for reconsideration is filed.
