An investigation by the Occupational Safety and Health Administration found that DME Construction Associates failed to protect workers from fall hazards at a municipal building project in Oyster Bay, New York, where employees were replacing steel roof decking. In August 2021 an employee fell about 18 feet through a skylight and later died from his injuries. OSHA determined that workers were exposed to fall hazards of up to 22 feet at unguarded roof openings and edges and that the company did not provide any personal fall protection equipment at the site. The settlement affirms all citations issued against the contractor, including nine “willful” violations. Eight of those were issued as “egregious,” “per-instance” citations for failing to provide fall protection to each of eight employees working on the roof. Under the agreement, which OSHA announced Monday, DME must pay a $600,000 penalty and take a series of corrective actions. Those include developing a comprehensive written safety plan, ensuring and documenting that sufficient fall protection equipment is available for every worker at every jobsite, and requiring all supervisors to complete OSHA’s 30-hour construction safety training. The company also agreed to notify OSHA at least one week before beginning any future jobs and to allow warrantless entry to its worksites. DME Construction Associates and its owner, Peter Chardon, pleaded guilty last year to a criminal violation of the Occupational Safety and Health Act related to the death and are to be sentenced in April, OSHA said.
