The decision, in Philadelphia Indemnity Insurance Company v. Oldfields School Inc. , was issued Thursday in the U.S. District Court for the District of Maryland in Baltimore. In a 2025 lawsuit, a woman identified as Jane Doe alleged a teacher sexually harassed and abused her from 2005 — when she was 14 — through 2009, after she left school. The teacher was fired from the school in 2007 due to the abuse, and the student graduated in the summer of 2008, according to the ruling. The student says she still suffers from panic attacks and anxiety, has felt suicidal and requires therapy. Philadelphia, a unit of Tokio Marine, insured Oldfields under a policy running from August 2008 to August 2009, that included coverage for liability tied to sexual or physical abuse. The insurer argued that the first abuse in 2005 predated the policy and that the teacher and student had both left the school before the policy began. The judge disagreed. He said the coverage form applies when “bodily injury,” defined to include emotional distress, occurs during the policy period. Coverage, he wrote, “does not turn on the timing of the ‘abusive conduct,’” but on the timing of the bodily injury. The student alleges distress and treatment beginning in 2008, he noted, which could fall within the policy period. The judge granted the school’s cross-motion on the duty to defend but delayed a decision on whether the insurer must pay any eventual judgment until the lawsuit is resolved.
