Donald D. Hill injured his right knee at work in April 2019 and underwent surgery and rehabilitation. A physician determined in May 2022 that he had been medically stationary since November 2020, and the employer closed his claim, according to Hill v. Trader Joes . The Workers’ Compensation Board upheld the closure. Legislation enacted in 2022 generally barred physicians from backdating medically stationary determinations more than 60 days. The changes applied to claims existing on Jan. 1, 2024, except disputes finally determined before that date. The employer argued that the requirements were not in effect when it closed the claim. The Oregon Court of Appeals found that Mr. Hill’s pending judicial appeal prevented the board’s decision from becoming final. Although the earlier claims-processing actions were lawful when taken, the court said the legislation required reconsideration under the new requirements. The court reversed the board’s order and remanded the case.
