Current legislation expires at the end of 2027. Senate Bill 4395 was introduced on April 27, 2026, by Sens. David McCormick R-Penn., Tina Smith D-Minn., Thom Tillis R-N.C. and Ruben Gallego D-Ariz., according to a statement from Sen. McCormick’s office. The U.S. House of Representatives passed its own version of the legislation on June 30. The Senate bill was a simple reauthorization, but the House bill raises the insured loss threshold for certifying a terrorist act from $5 million to $10 million, effective in 2029, and would also require the Treasury Department to provide notice during the certification process. The differences between the House and Senate bills must be resolved before legislation can be sent for presidential approval. “State sponsors of terror pose a persistent threat to the United States, and we must be prepared,” Senator McCormick said in the statement. TRIA, which was originally passed in 2002 after the Sept. 11, 2001, terrorist attacks in the U.S., was previously reauthorized in 2005, 2007, 2015, and 2019.
