Jacqueline Joiner reported immediate pain after restraining a 230-pound juvenile in August 2022. She later fainted and was subsequently diagnosed with sprains, a lumbar strain and post-concussion syndrome, according to Clark County and Corvel Corp. v. Joiner, filed in the Nevada Court of Appeals. An appeals officer denied the claim, finding that reports of pain did not establish an injury. The district court reversed. The appeals court found that the encounter, immediate pain and subsequent diagnoses supported the back, knee and foot claims. Soft-tissue injuries can be established through medical evidence even when they do not appear on X-rays, the court explained. The court upheld the denial of the head injury claim, citing conflicting evidence and Ms. Joiner’s report that hunger and dehydration likely contributed to her fainting. The case was remanded for further proceedings, with the court expressing no opinion on the scope of benefits she should receive. The ruling was unpublished.
