Jul 9, 2026 A group of nine directors and officers liability insurers led by a unit of The Hartford has lost its bid for prejudgment interest on $90 million the insurers advanced to sportswear maker Under Armour during a multiyear coverage fight. U.S. District Judge Richard D. Bennett of the District of Maryland denied the request in Navigators Insurance Co. et al. v. Under Armour Inc. , ruling that neither Maryland law nor the parties’ own funding agreements entitled the insurers to interest on the money. The dispute stems from a disagreement over whether a securities class action, several derivative suits and a related government investigation constituted one insurance claim or two. In 2024, Judge Bennett originally ruled in favor of Baltimore, Maryland-based Under Armour, prompting the nine insurers to advance about $10 million each under interim funding agreements while they appealed. The U.S. Court of Appeals for the Fourth Circuit reversed that ruling in January, finding the claims were a single event not covered by the extra $90 million under Under Armour’s 2017-2018 policies. Under Armour repaid the principal in full between March and April of this year. The insurers argued the funding agreements guaranteed interest as a matter of right under Maryland law, but Judge Bennett found the agreements’ repayment language too vague to create that entitlement. He also declined to award interest as a matter of discretion. “Under Armour’s prompt repayment of the principal underscores that it has not breached any contract or otherwise prolonged repayment such that discretionary prejudgment interest would serve equity or justice,” he wrote. The lead plaintiff was Navigators Insurance, a subsidiary of The Hartford. The other insurers were units of Allied World, American International Group, Argo, Axa XL, CNA Financial, Nationwide Mutual, QBE Insurance and Swiss Re.
