S.B. 162, introduced Wednesday, would amend Louisiana law governing the state’s workers compensation medical treatment schedule. Under current law, disputes over whether recommended care complies with the medical treatment schedule, or whether a variance is reasonably required, may be appealed to the Office of Workers’ Compensation Administration’s medical director or associate medical director. A party may then appeal that decision by filing a Disputed Claim for Compensation within 45 days of the issuance of the decision. The medical director’s decision may be overturned upon a showing, by clear and convincing evidence, that the decision was not in accordance with the statute. The proposed legislation would retain that framework and burden of proof but would limit the evidentiary record on further appeal. Specifically, it provides that the only evidence admissible in support of or in opposition to the disputed claim would be the evidence reviewed by the medical director or associate medical director. By restricting admissible evidence to the materials previously considered, the bill would bar parties from introducing new medical records, expert opinions or other documentation at the appeal stage before a workers compensation judge. If enacted, the measure would take effect Aug. 1.
