In New York Marine and General Insurance Co. v. Federal Insurance Co., decided Tuesday by the U.S. Court of Appeals for the Second Circuit, a cleaning worker was injured when a glass panel from a revolving door in an office building fell on her while she cleaned it. She sued building owners Old Slip Property and Beacon Capital Partners along with Bank of New York Mellon, which leased the floor where the accident occurred. Both the bank and the owners are based in New York City, and the bank is insured by Federal Insurance, the Chubb unit. The owners then claimed that Guzman’s employer, cleaning company PBM, caused the accident through negligence. PBM’s insurer, New York Marine and General Insurance, had agreed to add the owners and the bank as additional insureds on its policy. A district court ruled New York Marine had no duty to defend or indemnify either company, but the appeals court disagreed. The panel found that the owners’ third-party complaint against PBM, though “thin on concrete factual allegations,” was not “facially frivolous” and was enough to require New York Marine to step in and help with the defense. “Absent discovery and an evidentiary record, we cannot definitively rule out the possibility that [the cleaner] herself committed a negligent act that proximately caused the glass panel to dislodge,” they wrote. The judges cited a precedent finding that an insurer’s duty to defend can apply “no matter how groundless, false or baseless the suit may be,” so long as the claim falls within the policy’s scope when liberally construed. The court sent the case back to the district court for further proceedings, leaving open which insurers might be required to indemnify the case as well as defend.
