While U.S. District Judge Jennifer L. Rochon imposed several restrictions on the former Marsh employees, she declined to prohibit them from serving clients who had moved to Howden. In Marsh USA LLC v. Alfred Gronovius et al. , Judge Rochon found that Marsh showed a likelihood of success on breach-of-contract claims against the former employees and a tortious-interference claim against Howden. The court barred several of the defendants from soliciting Marsh employees and restricted others from soliciting or servicing Marsh clients covered by their covenants. Judge Rochon also ordered the individual defendants and Howden to return Marsh’s confidential information. However, she declined to stop the brokers from continuing to service clients who have already moved to Howden, citing the burden on the clients. As of early February, Marsh said it had lost about 160 employees and 82 clients to Howden. The judge issued a temporary restraining order in the case in November . The judge emphasized that the findings in the latest ruling are preliminary and not binding at trial. Motions to dismiss remain pending. Marsh has several other pending poaching suits against Howden. Howden declined to comment on the ruling.
