As documented in No. 2026-80-0091 , the worker was robbed at gunpoint while working for Walgreens on June 2, 2025, when an armed intruder forced her to empty an office safe. The record did not indicate she was physically assaulted. Two days later, the worker reported a mental injury, and Walgreens authorized counseling. The company later provided a panel of providers after she requested psychiatric treatment. The worker subsequently sought temporary disability and medical benefits, alleging numerous physical conditions related to the robbery, including a traumatic brain injury. No evidentiary hearing has been held on the merits of those claims. After the court ordered the parties to mediation, the worker did not participate, citing a medical emergency and hospitalization. She later told the court she was experiencing “brain fog” from an alleged traumatic brain injury and side effects from medication and could not participate in hearings or mediation. The Tennessee Workers’ Compensation Appeals Board said Tennessee workers compensation law requires parties to attend mediation and mediate issues in good faith. It rejected the worker’s due process argument, finding the judge had not barred an expedited hearing but had delayed it until the worker could participate. The board said the judge had a valid concern about the self-represented worker’s capacity to pursue benefits at an expedited hearing and remanded the case.
