Colony Insurance Company filed Colony Insurance Company v. Architectural Surfaces Group, LLC , on Wednesday in the U.S. District Court for the Western District of Texas. Colony is asking the court to rule that exclusions in its policies covering silica or “silica-related” dust and pollution bar coverage. The underlying lawsuits were filed by contractors, their spouses, or the estates of contractors who died after fabricating and installing stone countertops made by Architectural Surfaces Group, based in Boynton Beach, Florida. The workers claim they inhaled silica dust and other toxic particles released during the cutting and shaping of the stone, leading to illnesses including silicosis, lung disease, and pulmonary fibrosis, along with a heightened risk of cancer. Since 2022, more than 500 suits against Architectural Surfaces Group have been filed in state courts in California, Arizona, Florida, Kentucky, Oregon, Nevada, and Washington, as well as in federal court, according to the complaint . Silicosis lawsuits have led to more than $200 million in jury verdicts and settlements for stone fabricators, causing insurance rates in the stone industry to soar. California is considering banning artificial stone countertops after medical experts have warned that the stone cannot be cut safely. Judges in many cases have found that insurers still must cover the defense of stone makers in these suits despite silica or pollution exclusions.
