Melvin Smith sustained head and other injuries in December 2022 when his truck struck a barrier while returning from a sand delivery. RNK Construction denied medical and wage benefits, according to Melvin Smith v. RNK Construction, L.L.C. and CNA Insurance Companies, filed in the Louisiana Court of Appeal, Fourth Circuit. A workers compensation judge agreed with RNK that Mr. Smith was an independent contractor. Records showed RNK owned, maintained and insured the truck, assigned deliveries and monitored his location through GPS. Mr. Smith wore a company uniform and signed employment documents outlining rules and potential discipline. RNK argued that he received a 1099 tax form, paid his own taxes and received no employee benefits. The appeals court, however, found that those arrangements did not overcome the evidence that RNK controlled his work and could terminate him at will. The divided court reversed and remanded for a determination of benefits owed.
