In Motiva Enterprises, LLC v. Tyler Whitmire , the Texas Court of Appeals, 9th District held that Motiva Enterprises qualified as the injured worker’s statutory employer because it provided workers compensation coverage through a contractor-controlled insurance program. The case arose from a 2020 incident in which Tyler Whitmire, an employee of subcontractor RRR Electripro, alleged he was injured while working at the company’s facility. He sued despite receiving workers compensation benefits under a policy tied to the contractor program. Motiva argued that under the Texas Workers’ Compensation Act, it was deemed the worker’s employer for workers comp purposes because it had a written agreement to provide coverage to the subcontractor and its employees. The exclusive remedy provision bars covered employees from suing their employer for workplace injuries. The appellate court agreed, finding the company conclusively established that the agreement was in place before the injury and that the worker received benefits under the program. The court also rejected arguments that contract language describing the subcontractor as an independent contractor waived the exclusive remedy defense, saying such provisions do not override statutory employer status for workers compensation purposes. The court reversed the trial court and rendered judgment for Motiva, ending the case.
