U.S. District Judge Lewis J. Liman of the Southern District of New York on Tuesday denied the motion in Harco National Insurance Company v. Wayfarer Studios LLC. The case centers on whether Harco, a subsidiary of IAT Insurance Group, must cover defense costs the defendants incurred fighting a since-settled lawsuit brought by Ms. Lively over alleged mistreatment during production of the film. Raleigh, North Carolina-based Harco issued two management liability policies to Wayfarer covering directors and officers liability and employment practices liability. The insurer denied coverage for Ms. Lively’s lawsuit, arguing the defendants already knew about potential claims before the policies took effect. It cited warranty language stating coverage is excluded for any circumstance the insured had “knowledge or information of” beforehand. The defendants had argued the case should be paused because they separately sued three other insurers in California state court over related coverage disputes. Judge Liman rejected that argument, finding no meaningful overlap between the cases because Harco is not a party to the California lawsuit and the policies at issue differ. He wrote that declining jurisdiction would “undermine judicial efficiency” and “force a California court to consider a case which has not yet been filed before it.” The judge also found no evidence Harco filed suit to gain unfair procedural advantage, noting the insurer waited roughly a month after stating its coverage position before filing, during which “defense costs were piling up for which if there was coverage, Harco would have been liable.” The ruling allows Harco’s declaratory judgment action to proceed, keeping the coverage dispute in federal court rather than transferring it to California. Sexual harassment allegations have complicated the film insurance market since the onset of the #MeToo movement, experts say.
