In Marsh & McLennan Agency LLC v. Patriot Growth Insurance Services LLC et al. , filed in New York state court Wednesday and later moved to federal court, Marsh alleges that Patriot Growth, which is based in Fort Washington, Pennsylvania, induced former Marsh employees to breach nonsolicitation and confidentiality agreements. According to the complaint, 11 Marsh employees resigned during the week of May 18, most on the same day, leaving resignation letters on their laptops and walking out. The departing workers, most of whom had worked for Marsh or predecessor firm, J. Smith Lanier & Co., since the mid-2000s, joined Patriot’s newly opened Birmingham office, which operates as Turner Insurance & Bonding Co. Several of the employees are accused of meeting with Marsh clients before resigning to inform them of their plans and solicit their business. In one instance, the complaint alleges, a departing producer asked a client to sign several documents without disclosing that one of them was a broker of record letter transferring the client’s account from Marsh to Patriot Growth. Marsh says it has since received at least 71 such broker of record letters representing a $3.5 million revenue loss. Three of the departing employees filed a declaratory judgment action in Jefferson County, Alabama, thirteen minutes after their resignations took effect, seeking to have their Marsh agreements declared unenforceable, according to the complaint. Patriot Growth Insurance declined to comment.
