A life enrichment manager at Sunrise of Bethesda sustained a fractured spine, contusions and bruising when a resident assaulted her in January 2022, according to Case No. C-15-CV-23-003007, filed in the Appellate Court of Maryland. The state Workers’ Compensation Commission found the woman’s injury compensable and ordered Sunrise to pay her medical expenses. She later sued, alleging negligence and negligent supervision. She argued that factual disputes remained regarding whether she had elected workers compensation remedies and whether Sunrise was her employer. The appeals court found that her claim identified Sunrise as her employer and that she personally attended a hearing, added psychological injuries to the claim and accepted the award. Those actions constituted a binding election of workers compensation remedies, the court found. The court affirmed summary judgment for Sunrise, noting that the woman could still seek additional comp benefits if her condition worsened.
