An experience modification factor, or e-mod, is a numerical rating used by insurers to adjust an employer’s workers compensation premium based on its past claims history, with higher scores indicating greater risk and higher costs. S.B. 175 would require insurers to update an employer’s experience modification factor to reflect the actual amount paid on a closed claim rather than higher reserve estimates reported while the claim was still open. Under the proposal, employers or licensed insurance producers could request a revision if an open claim was initially reported with a higher value than the final paid amount and the adjustment would reduce the employer’s experience modification factor by at least 0.05 or bring it to 1.0 or lower. The bill requires employers to notify the insurer between the time a claim is reported to a rating bureau and up to 31 days after the employer’s rating effective date. Upon notification, the insurer must instruct the rating organization to revise the experience modification factor accordingly. Rating organizations would then have 30 days to complete the adjustment, and insurers would be required to credit employers for any resulting premium changes during the policy period. The measure is designed to address situations in which reserves on open claims inflate experience modification factors, potentially leading to higher premiums even after claims ultimately close at lower amounts. If enacted, the bill would take effect Jan. 1, 2027, and apply to claims closed on or after that date.
