In Harford Mutual Insurance Co. v. Millers Capital Insurance Co. , decided Thursday, United States Magistrate Judge J. Mark Coulson of the District of Maryland granted summary judgment to Harford, a Bel Air, Maryland-based insurer that defended property manager Alvin L. Aubinoe Inc. but sought a declaration that the building owner’s insurer was responsible for that defense instead. The underlying case involves a tenant in a Washington apartment building owned by 3921 Kansas LLC and managed by Aubinoe. The tenant alleges that a worker Aubinoe dispatched to make repairs in her unit sexually assaulted her. She brought claims of negligence, assault and battery, and negligent hiring, retention, and supervision, among others, against Aubinoe and the building owner. Camp Hill, Pennsylvania-based Millers Capital Insurance Co., which insured 3921 Kansas, had issued a commercial general liability policy that defined an insured as “any organization while acting as your real estate manager.” Millers Capital argued it owed no duty to defend Aubinoe because a management agreement between 3921 Kansas and Aubinoe contained indemnification language that effectively shifted liability back to the property manager. Judge Coulson rejected that argument, finding that Millers Capital’s policy created an independent obligation to defend Aubinoe separate from any contract between the building owner and the property manager. Millers Capital “cannot plausibly contend that Aubinoe is not acting as a ‘real estate manager’ when it vets, hires, trains, and supervises its own employees,” the judge wrote.
