A Tampa, Florida, restaurant recently drew criticism after a diner spotted a 3% “venue fee” on her bill that was allegedly not disclosed on the menu or at the location, according to the New York Post. The restaurant, RO in Hyde Park, reportedly had not responded to the Post’s request for comment. That kind of bill-padding may soon be harder to hide. Florida’s S.B. 606 is set to require restaurants that charge an operations fee, automatic gratuity or service charge to disclose the charge on menus, written contracts and ordering websites or apps. Receipts and bills must also separately list gratuity, operations charges and sales tax. For restaurants, the compliance lesson is simple: surprises are for birthday desserts, not receipts. The issue is spreading beyond Florida. California, Illinois and New York have also moved to crack down on hidden or mandatory fees, with rules aimed at making sure diners know the true cost before they order.
