The U.S. District Court for the Middle District of North Carolina in June dismissed dueling defamation claims between TC Heartland LLC, which manufactures Splenda, and researcher Susan Schiffman, ruling that their dispute over artificial sweeteners belonged in the “marketplace of ideas and laboratories,” Retraction Watch reported. The spat began after Ms. Schiffman co-authored a 2023 study that found a compound related to sucralose to be genotoxic and called for a regulatory review. The paper did not mention Splenda, but TC Heartland sued after Ms. Schiffman publicly discussed the research, including in an interview with Raleigh, North Carolina, television station WRAL, according to the report. Ms. Schiffman countersued after the company created a webpage challenging her work. The court tossed both claims, finding that each side had a First Amendment right to criticize the other’s conclusions. It also warned that letting the litigation proceed could leave scientists thinking twice before wading into controversial research.
