Rae Rodriguez, an employee of Willis-Knighton Health System, injured her lower back, neck and right arm in June 2024, when she tripped over a car seat strap and struck a chair and filing boxes before falling to the floor. She sought workers comp benefits and additional treatment after the employer’s claims administrator terminated benefits, according to Rae Rodriguez v. Willis Knighton Health, filed in the Louisiana Court of Appeal, Second Circuit. Ms. Rodriguez answered no on questionnaires in 2022 and 2024 when asked whether she had experienced an on-the-job accident or had been advised to undergo surgery that remained uncompleted. Records showed she previously injured her neck while pulling a heavy door at another employer and that a physician said she would likely benefit from cervical fusion surgery. She also injured her knee and foot in a separate workplace fall. Ms. Rodriguez argued that the questions were vague and that she did not consider the earlier incidents work accidents because she had not missed work or received benefits. The appeals court rejected those arguments, finding that her responses concerned the same medical condition for which she sought benefits and impaired Willis-Knighton’s ability to seek reimbursement from Louisiana’s second injury fund. The court affirmed the workers compensation judge’s forfeiture ruling. Both questionnaires warned that untruthful answers could result in the loss of benefits.
