The iPhone maker alleged in a Monday court filing that OpenAI is destroying evidence in a trade secrets lawsuit centered on Chang Liu, a former Apple engineer who joined the artificial intelligence company in January, Bloomberg reported. Apple said a forensic examination of an Apple-issued MacBook used by Mr. Liu showed that he downloaded a confidential circuit schematic and used it in his work at OpenAI. The computer also allegedly contained evidence that Mr. Liu sent instructions for destroying evidence to an OpenAI colleague who agreed to comply. The allegations support Apple’s request for expedited discovery in its lawsuit accusing OpenAI, two former Apple employees and an OpenAI hardware unit of misappropriating trade secrets to develop consumer devices. OpenAI has denied wrongdoing and moved to dismiss the case. It has said Mr. Liu accessed Apple’s cloud data to assist a former colleague and that it followed standard recruiting practices when hiring Apple employees. Apple is seeking damages and an order barring OpenAI from using its proprietary material. A hearing is scheduled for Oct. 1.
